According to ICC prosecutor Karim Khan, five nations referred cases to the ICC for inquiry into potential crimes that may have been committed on Palestinian territory.According to Khan, the reference to the regional issue was made by Djibouti, Bolivia, Comoros, South Africa, and Bangladesh.
When one or more offences under the court’s jurisdiction seem to have been committed, a state party may report the prosecutor to the appropriate authority in line with the Rome Statute of the International Criminal Court. The prosecutor will then investigate the situation to determine whether one or more specific persons should be charged with the commission of such crimes,” Khan stated in a statement.
He mentioned that his office has already started looking into any crimes that may have been committed in Gaza and the West Bank since June 2014 as part of an investigation into the situation in the Palestinian territories that started on March 3, 2021.
According to Khan, “it is ongoing and includes the escalation of hostilities and violence since the attacks that occurred on October 7, 2023.” “My Office has jurisdiction over crimes committed on the territory of a State Party and with respect to the nationals of States Parties, in accordance with the Rome Statute.”
